Overview

Welcome to Tucarma Property Services (TPS). By engaging our services or using our website, you agree to comply with the following terms and conditions. Please read them carefully, as they outline your rights and obligations when working with us.

Scope of Services

TPS offers commercial cleaning, property maintenance, tenancy fit-outs, vending amenities, and related services. The specifics of the services provided will be detailed in individual agreements or project scopes, which form part of this overarching agreement.

Client Responsibilities

To ensure the smooth delivery of services, clients are responsible for:

  • Providing clear and accurate information regarding the site and service requirements.
  • Ensuring access to the property during agreed service times.
  • Addressing any hazardous conditions that may affect TPS staff or subcontractors.
  • Promptly notifying TPS of any changes to project requirements.

Quoting and Payment

Quoting: All quotes provided are valid for 30 days from the date of issue. TPS reserves the right to adjust quotes based on site inspections or changing project scopes.

Deposits: A deposit may be required for certain projects prior to commencement.

Payment Terms: Invoices are due within 14 days of issuance unless otherwise stated in the agreement. Late payments may incur interest charges at the rate of 5% per month.

Additional Costs: Unforeseen issues that arise during service delivery, requiring additional work or materials, will be communicated to the client for approval before proceeding.

Cancellations and Rescheduling

  • Client Cancellations: Cancellations made within 48 hours of a scheduled service may incur a cancellation fee.
  • TPS Cancellations: TPS reserves the right to reschedule services due to weather conditions, safety concerns, or unforeseen circumstances. Clients will be notified and an alternative date will be arranged.

Liability and Insurance

TPS carries full public liability insurance and ensures all employees and subcontractors are covered by appropriate worker’s compensation insurance.

While every precaution is taken, TPS is not liable for:

  • Incidental or consequential damage arising from the services provided.
  • Pre-existing property damage or structural faults.
  • Delays caused by third-party suppliers or subcontractors.

Clients must notify TPS of any service-related damage within 48 hours of service completion.

Work Health & Safety (WHS)

TPS adheres to strict health and safety policies in line with Australian OH&S regulations. We are committed to maintaining safe work environments for our staff and clients by:

  • Conducting site-specific risk assessments.
  • Providing ongoing staff training in safety procedures and compliance.
  • Enforcing the use of personal protective equipment (PPE) where necessary.

Clients are responsible for notifying TPS of any known risks at the site prior to service commencement.

Intellectual Property

All content, designs, and materials provided by TPS during the delivery of services remain the intellectual property of TPS unless otherwise agreed. Clients may not reproduce or distribute TPS materials without written consent.

Privacy and Confidentiality

TPS respects your privacy. Any information collected during service engagements will be handled in accordance with our Privacy Policy. Client information will not be shared with third parties unless necessary for service delivery or required by law.

Dispute Resolution

In the event of a dispute, both parties agree to engage in good faith negotiations to resolve the issue. If a resolution cannot be reached, the matter may be referred to mediation in accordance with Australian commercial dispute guidelines.

Termination of Services

TPS reserves the right to terminate services if:

  • The client breaches any part of this agreement.
  • Payments are overdue by more than 30 days.
  • Site conditions are unsafe for staff or subcontractors.

Clients may terminate services by providing written notice 14 days in advance. Any outstanding balances for services rendered must be settled prior to termination.

Changes to Terms of Service

TPS reserves the right to update these Terms of Service at any time. Updated terms will be posted on our website, and clients will be notified of significant changes.
